House Keeping


Below ‘your’ or ‘you're’ or 'you' refers to the person or

business responsible for honouring any and all agreements.


Below ‘we’ or ‘we're’ or 'us' refers to the person or staff member within Cookie Cut Media.


Below ‘package’ and ‘contract’ refer to the

‘Package 1’ or ‘Package 2’ options.

Terms & Conditions for Monthly Social Media Packages 1 & 2.



Packages Types


1.a) The individual taking out a package is responsible for making payment and so should be or have permission from the bill payer.


1.b) Your package will include 'animated text'. The content of which will be pre-agreed with you. 'animated' refers to how the texts will appear and disappear on screen. This will often be a simple swipe & fade up or down. 


1.c) Your package will contain music track/s. These track/s are royalty free music provided by a third party. The track/s have been cleared for public exhibition and are subject to no restrictions other than the music track/s should not be used on any non Cookie Cut Media projects. 


1.d) All videos will finish with a small 'Powered by Cookie Cut Media' logo. A sample of which is available on request. 


1.e) Cookie Cut Media retains the right to use your video material as part of its’ own marketing materials. 



Applying & Cancelling


2.a) Applying for a package does not guarantee your contract and or package type, you will be independently contacted confirming your contract and package type by a member of the Cookie Cut Media team, this confirmation may be subject to a deposit.


2.b) Cookie Cut Media reserves the right to cancel your contract at anytime. 


2.c) If these Terms & Conditions are not adhered to you may not be entitled to a refund.



Refunds


3.a) Deposits are non refundable.


3.b) If you pay your 'shooting fee' or 'optional extra shooting fee' but do not use the service you may be entitled to a refund.


3.c) Once a service has been provided you are no longer entitled to a refund for that service.


3.d) To apply for a refund please contact proejcts@cookiecutmedia.co.uk outlining your request.



Package Payments


4.a) Once your contract is signed you will be agreeing into a 12 month contract, starting from the date of the first videos delivery, by doing so you are agreeing to pay the advertised package monthly fee by Standing Order on the 1st of every-month. 


4.b) Failure to pay could lead to the premature termination of your contract.


4.c) Cookie Cut Media may ask for a non refundable deposit at Cookie Cut Media's discretion. 


4.d) 'Optional extra shooting fees' are subject to quote, starting at £150.00.



Shooting and Delivery


5.a) If you wish to re-schedule a shoot you must do so with at least 24 hours notice of the shooting date and time at: projects@cookiecutmedia.co.uk, failure to do so may cause you to be charged the full quoted shooting fee without the option of re-scheduling.


5.b) Although Cookie Cut Media strives to best represent, shoot and deliver content, once an idea and or concept has been agreed with you, shot and delivered, Cookie Cut Media cannot be held financially responsible if you are not satisfied with the end content.


5.c) When downloading content from Cookie Cut Media - Cookie Cut Media puts the security of client at a high priority. Therefore, we have put efforts into ensuring that the message and video downloads are error and virus-free. Unfortunately, full security of the email cannot be ensured as, despite our efforts, the data included in emails could be infected, intercepted, or corrupted. Therefore, the recipient should check the email and download links for threats with proper software, as the sender (Cookie Cut Media) does not accept liability for any damage inflicted by viewing or downloading the linked content.

Terms & Conditions for all other projects.



Project & Video Payments


Deposits


6.a) Upon agreeing a proposal and or quotation you will be issued with a deposit request this will typically be charged at 10% to 20% of the overall projects value. 


6.b) Deposits are non-refundable.


6.c) Your project and any work relating to your project will only begin once the deposit finance is secured in full. 


6.d) All invoice and quoting will be sent to you via a third party system under the jack@cookiecutmedia.co.uk.


6.e) Failure to pay your deposit promptly could void your quotation, or any pre-agreed dates and times. 



Payment Terms


7.a) Cookie Cut Media requires payment on delivery for all our work. Any outstanding money owed must be settled within 7 days of content delivery. 


7.b) We offer a number of payment options including Bank Transfer, Credit & Debit card payments and Standing Order.


7.c) When paying via BACs always include your project number in the reference.  



Cancelling Your Project


8.a) If you decided to cancel your project during production you may be liable to pay of any outstanding chargers incurred at the point of cancelation, this may include and is not limited to; company expenses, professionally charged time and purchased items or assets specific to your project as well as third party charges.


8.b) If you cancel a project you will not receive or be permitted to keep, or exhibit any media relating to the project.



Our Guarantees 


9.a)  Our Guarantees only cover video projects which we, Cookie Cut Media, have filmed and edited.


9.b) Our Guarantees came into effect on 1.1.2021 and only covers qualifying projects there after.



9.c) 
'WE’LL NEVER USE CONFUSING JARGON' - We, Cookie Cut Media agree to not use confusing jargon heavy language during any of our communications, we will however at times need to use industry and technical terms. If we use any language that might be deemed to be confusing we will always do our best to explain its meaning. Should you feel confused at any stage please ask us to explain ourselves. 


9.d) 'SIMPLE CLEAR PRICING FROM THE START.' -We, Cookie Cut Media will never charge more than has been officially quoted and agreed, should there be any changes to add to a quoted project during its production we’ll notify you for approval before your quote is updated. 


9.e) 'YOU’LL KNOW THE PROGRESS OF YOUR PROJECT EVERY STEP OF THE WAY.' - We, Cookie Cut Media will update you as often as we feel necessary. The update may be given by phone, in person or on email. When your content is in the edit you have the option of using our Review platform, allowing you to update use with live comments and feedback on the current draft video..


9.f) 'WE’LL NEVER CAUSE A PROJECT TO MISS A DEADLINE' - The 'deadline' must be commonly agreed in writing between ourselves Cookie Cut Media, and the respective client (yourself).


9.g) 'WE’LL NEVER CAUSE A PROJECT TO MISS A DEADLINE' - We, Cookie Cut Media will always do our best to honour an agreed project deadline. For any reason should we be unable to make a pre-agreed event during the projects production we’ll always do our upmost to re-arrange without impacting the projects final deadline. Cookie Cut Media is not responsible for deadlines not met due to third party or client involvement. 


9.h) 'NOT HAPPY WITH YOUR VIDEO? WE'LL REFUND YOU.' - You have 7 days from the project delivery to request a re-fund. Requests must be made in writing by post or e-mail, outlining the reasons for the dissatisfaction in the video. Delivery of this must be verified by speaking directly to Cookie Cut Media to inform them of the request. Any requests for refund must include detailed reasons for the dissatisfaction with the video. Failure to do so within this time period will void your right to claim a refund. Upon receipt of any refund claim Cookie Cut media reserve the right to rectify any deficiency. Rectification to take no longer than 6 weeks from the receipt of the refund claim. Should Cookie Cut Media be unable to rectify the deficiency during that time subject to the other T&Cs in the list the refund will be processed.


9.i) 'NOT HAPPY WITH YOUR VIDEO? WE'LL REFUND YOU.' - Deposits remain non-refundable, and so will be deducted from the overall project value.


9.j) 'NOT HAPPY WITH YOUR VIDEO? WE'LL REFUND YOU.' - Should you decide to request a refund you will forfeit your right to use any of the media, visual and audio produced by Cookie Cut Media including any third-parties content we may have engaged to complete your project. 


9.k) 'NOT HAPPY WITH YOUR VIDEO? WE'LL REFUND YOU.'.  - This guarantee does not include any costs incurred from our suppliers or any third party companies. Any finances spent by ourselves or you in these circumstances will not be returned or owed to you.


9.l) 'NOT HAPPY WITH YOUR VIDEO? WE'LL REFUND YOU.'  - We, Cookie Cut Media are not responsible nor guarantee refunding any charges, expenses or other financial investment or losses incurred by you outside of our project involvement. For example, you will not be refunded for an invest you make in a location or actors separately to Cookie Cut Media.



Estimates, Proposal or Quotation


10.a) All estimates, proposals and quotations will give a detailed layout of what you can expect from Cookie Cut Media. Do not sign or agree to project if this is not clear to you from the outset.


10.b) All estimates, proposals and quotations will include a deadline, should you agree after this deadline we may need to re-quote for your project.


10.c) It will be considered that you have agree a quotation and have the bill payers permission to pay the overall value of the project if you agree to the quotation by email, signing the proposal or estimate or quotation and deliver it back to one of Cookie Cut Media’s email address or postal address. 


10.d) We, Cookie Cut Media will always do our best to communicate our ideas and vision for the end project when creating and presenting and pre-production documents, however these documents including but not limited to estimates, proposals and quotations are open to interpretation which may mean the content delivered can be perceived to vary from your agreed expectations.

Terms & Conditions for Talking Head Sessions


11.a) Session deposits are non-refundable.


11.b) 48 hours notice ahead of your booking time and date is required to move or cancel a booking. Failure to do so may mean you are still charge the full rate for your session.


11.c) Music is supplied by a 3rd party supplier and so is subject to their own set of regulations: https://artlist.io/


11.d) Discount codes must be given at the point of booking.


11.e) Cookie Cut Media reserves the right to cancel or move any bookings


11.f) Cookie Cut Media reverses the right to decline any booking request.



Finishing up


12.a) A copy of these Terms & Conditions is available on email request at: productions@cookiecutmedia.co.uk 


12.b) All videos will finish with a small 'Powered by Cookie Cut Media' logo. A sample of which is available on request. This can not be removed ay anytime during the lift time of the video.


12.c) If these Terms & Conditions are not adhered to you may not be entitled to a refund.


12.d) Cookie Cut Media retains the right to use your video material as part of its’ own marketing materials. 


12.e) Cookie Cut Media reserves the right to change these Terms & Conditions at anytime. Your statutory rights will not be effected.
